1. Introduction Welcome to Moments (the "App"), developed by BrainWaveAi ("we," "us," or "our"). We are committed to protecting your privacy. This Privacy Policy explains how we handle, process, and protect your information when you use our App. By downloading and using Moments, you agree to the practices described in this policy.

2. Data Collection and Usage Moments is designed to function primarily offline and respects your privacy by keeping your personal data on your device.

Local Storage Only: All data you create within the App—including event titles, dates, emojis, colors, font styles, notification preferences, premium status, and widget selections—is stored locally on your device.

No Personal Information Collected: We do not collect, store, or transmit personally identifiable information (PII) such as your name, email address, phone number, or contacts to our servers.

No Location Data: The App does not request, access, collect, or share your precise or approximate location data (GPS).

3. Device Permissions To provide the core functionalities of the App, we request the following device permissions. We only use these permissions for their stated purposes:

POST_NOTIFICATIONS: Used exclusively to send you daily reminders for your configured events.

RECEIVE_BOOT_COMPLETED: Used to automatically restore your event alarms and notifications after your device restarts.

INTERNET & ACCESS_NETWORK_STATE: Used to check network connectivity and load advertisements or remote configurations.

WRITE_EXTERNAL_STORAGE: Used only on Android 9 and below to allow you to share images of your events.

4. Third-Party Services and Advertising While we do not collect your personal data, the App uses third-party services that may collect information used to identify you for advertising purposes.

Google AdMob: We use Google AdMob to display native, interstitial, and rewarded video ads. AdMob may use advertising IDs and collect data regarding your interaction with ads to provide personalized advertising. 5. Data Retention and Deletion Because all user-generated data is stored locally on your device, we do not hold any of your data on our servers.

Data Deletion: You have full control over your data. You can delete individual events directly within the App. To completely delete all data associated with the App, you simply need to clear the App's data in your device settings or uninstall the App.

6. Children's Privacy Our App does not knowingly collect or solicit personally identifiable information from children under the age of 13 (or the applicable age in your country). If you are a parent or guardian and believe your child has provided us with personal information, please contact us so we can take necessary actions.

7. Changes to This Privacy Policy We may update our Privacy Policy from time to time. We will notify you of any changes by updating the "Last updated" date at the bottom of this document. You are advised to review this Privacy Policy periodically for any changes.

1. Acceptance of Terms By downloading, installing, or using the Moments application (the "App"), developed by BrainWaveAi ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App and delete it from your device immediately.

2. Description of Service Moments is a utility application that allows users to create and track important events, displaying the days remaining or passed since a specific date. The App includes home screen widgets, customizable notifications, and premium features (such as additional colors and fonts) that can be unlocked by viewing rewarded video advertisements.

3. Minimum Age Requirement You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms and Conditions.

4. Explicit Consent and User Conduct By using the App, you grant explicit consent for the App to utilize the necessary device permissions (such as notifications and internet access) to function as described. You agree NOT to engage in any of the following prohibited conduct:

Reverse engineering, decompiling, or disassembling the App.

Using the App for any illegal, unauthorized, or malicious purposes.

Interfering with or disrupting the integrity or performance of the App or its third-party services (e.g., ad blockers that violate third-party terms).

Attempting to bypass the rewarded video ad system to unlock premium features without viewing the required advertisements.

5. Intellectual Property All intellectual property rights in the App, including but not limited to its design, code, graphics, text, and trademarks, are owned by BrainWaveAi. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes.

6. No Warranties ("AS IS") The App is provided on an "AS IS" and "AS AVAILABLE" basis. BrainWaveAi makes no warranties, expressed or implied, regarding the App's reliability, accuracy, or availability. We do not warrant that the App will be error-free, uninterrupted, or free of bugs or viruses. Your use of the App is at your own risk.

7. Limitation of Liability To the maximum extent permitted by applicable law, BrainWaveAi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or other intangible losses resulting from your access to or use of, or inability to access or use, the App.

8. Termination We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. You may terminate this agreement at any time by uninstalling the App and destroying all copies of it.

9. Governing Law and Jurisdiction These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Argentina. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in the city of Viedma, province of Río Negro, Argentina.
