BrainWaveAi ("we", "us", or "our") built the NeuralFlash app as a Commercial app. This SERVICE is provided by BrainWaveAi and is intended for use "AS IS".

If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. 1. Information Collection and Use For a better experience while using our Service, we may require you to provide us with certain personally identifiable information. NeuralFlash is designed to test and improve mental agility and reaction speed.

Local Processing: Your personal records, reaction times, and game progress are processed and stored locally on your device.

Location Data: We DO NOT request, collect, access, or share your precise or approximate location data (GPS).

Automatically Collected Data: The app may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, and diagnostic data (such as crash logs) to help us improve the app's stability.

2. Third-Party Services The app does use third-party services that may collect information used to identify you. These services are used strictly for analytics, crash reporting, and serving advertisements (if applicable). We ensure that these third parties comply with strict data protection standards. 3. Data Retention and Deletion We will retain your automatically collected data for as long as you use the Application and for a reasonable time thereafter. Since your gameplay data and personal records are stored locally on your device, you have full control over this data. You can delete all your data at any time by uninstalling the NeuralFlash application or by clearing the app's data in your device's settings.

4. Disclosure of Data We do not sell, trade, or rent your personal identification information to others. We may disclose automatically collected information:

When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

5. Children’s Privacy These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do the necessary actions.

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the NeuralFlash mobile application (the "Service") operated by BrainWaveAi ("us", "we", or "our").

1. Acceptance of Terms By downloading, accessing, or using NeuralFlash, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service NeuralFlash is a mobile application designed to challenge users' limits, break personal records, and achieve peak mental agility through reaction speed exercises. The app is for entertainment and personal self-improvement purposes only and does not provide medical or psychological diagnoses or treatments.

3. Minimum Age Requirement You must be at least 18 years old to use this Service. By using NeuralFlash and agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

4. Explicit Consent By using the Service, you explicitly consent to the collection and processing of your interaction data (such as reaction times and usage metrics) as outlined in our Privacy Policy, strictly for the purpose of providing and improving the Service.

5. Prohibited Conduct You agree not to use the Service in any way that is unlawful, illegal, or prohibited by these Terms. Specifically, you agree NOT to:

Reverse engineer, decompile, or disassemble the app.

Attempt to hack, manipulate, or artificially alter your scores or the app's mechanics.

Use the app to track, spam, or harass other users.

6. Intellectual Property The Service and its original content, features, functionality, graphics, and code are and will remain the exclusive property of BrainWaveAi and its licensors. 7. No Warranties ("AS IS") The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BrainWaveAi makes no representations or warranties of any kind, express or implied, regarding the operation of the Service, its accuracy, reliability, or the results you may obtain by using the app. We do not warrant that the app will be error-free, secure, or uninterrupted.

Limitation of Liability To the maximum extent permitted by applicable law, in no event shall BrainWaveAi, its developers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

9. Termination We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law and Jurisdiction These Terms shall be governed and construed in accordance with the laws of the Republic of Argentina, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in the city of Viedma, province of Río Negro, Argentina.
